Decree-Law No. 31/2007, of February 14, aimed to create conditions for the opening of the export credit insurance market with State guarantee, allowing this activity to be attributed to the entity that, at each moment, demonstrated to be better able to do so. Since 2007, access to the insurance system with State guarantee depends on a previous selection and contracting procedure with the State, after consulting the Council on Financial Guarantees for Exports and Investment. According to the clarification received from the General Directorate of Treasury and Finance, "due to constraints of different nature, it has not yet been possible to carry out the procedures for selection and contracting". In view of the above, and considering that no objective justification was identified for not having implemented of the prior selection and contracting procedure with the State, under a competition regime, the Competition Authority recommended the Government to make the best efforts necessary to implement the procedures, foreseen for more than 10 years, aimed at opening the market.
