On 23.05.2025, the AdC issued a set of comments and proposals, from a competition perspective, for the evaluation and review procedure of the European Union (EU) Public Procurement Directives, adopted in 2014 (Classic Directive; Special Sectors Directive and Concessions Directive), in response to a request for contributions, as a Member of the Advisory Board of the Institute of Public Markets, Real Estate and Construction, I.P. (IMPIC).
The AdC highlighted positively the provisions in the EU Public Procurement Directives that expressly establish a principle of competition in public procurement, emphasising that the core of the legislative and regulatory framework for public procurement must be to create competition in procedures.
The AdC made specific comments and proposals for legislative changes, to be considered by the European legislator, in relation to the following matters: subcontracting; awarding contracts by lots; preliminary market consultation, provision of information and impediments; grounds for exclusion and impediments; abnormally low price or cost; base price; declaration of independence of tenders; and duration of public works and public service concession contracts.
