Case opened, on 10.02.2005, on its own initiative, based on a concerted practice in the pharmaceutical sector, involving 5 laboratories, in which prices were fixed in several hospital public tenders for the supply of blood glucose test strips.
Sufficient evidence was gathered which led to the five pharmaceutical companies being charged with concerted practices consisting of submitting uniform prices in 36 public tenders for the supply of 22 hospitals.
On 10.01.2008, the Supervisor's Council issued a condemnatory decision.
It should be noted that, following the adoption of a first conviction decision by the Competition Authority on 25.11.2005, and an appeal by the defendants, the Commerce Court annulled the process up to the Statement of Objections, on defence nullity grounds, repeating all procedures from the Statement of Objections onwards.
