Summary of the case

The infringement proceeding was opened by the Portuguese Competition Authority (AdC) on July 08, 2010, following a complaint filed by Cabovisão - Televisao Cabo, S.A ..
In the investigation carried out by AdC, behaviours adopted by Sport TV Portugal, SA (SPORT TV) in the national market of premium access channels with premium sports content were analysed, and it was concluded that SPORT TV abused its dominant position by implementing a discriminatory remuneration system, based on the distribution agreements of SPORT TV television channels concluded between this company and the companies operating the subscription television services. The remuneration system in question was in force from January 1, 2005 until April 1, 2011.

According to the AdC, SPORT TV was consistently applying discriminatory (or unequal) conditions and was exploiting its dominant position in the market for payed access channels. premium sports content through the imposition of unfair trading conditions and limiting production, distribution, technical development and investment in relation to the services concerned. The AdC concluded the proceeding with a condemnatory decision on June 14, 2013, setting a fine of € 3,730,000.00 (three million seven hundred and thirty thousand euros).
