The Portuguese Competition Authority (AdC) opened an infringement proceeding on 11.03.2010, based on a leniency application. The Statement of Objections was approved on 08.02.2012. Between 2001 and 2010, the four defendant companies: Contiforme – soluções gráficas integradas, S.A.; Copidata, S.A.; Formato – formulários múltiplos comerciais, S.A.; Lithoformas portuguesa – impressos contínuos e múltiplos, S.A., operating in the national market of commercial forms and forms, determined among themselves the terms by which they would act in the market, fixing prices and dividing customers and markets.
With regard to the defendants natural persons, in their capacity as members of the boards of the identified defendant companies, there was also evidence that, having, or should be aware of, an infringement committed by the companies of which they were part of, they did not put an end to it.
The AdC concluded the proceeding with a condemnatory decision on 13.12.2012, determining fines in the total amount of 1.797.978,51 euros (companies) and 6.000,00 euros (members of the board accused).
