Summary of the case

The AdC issued a Recommendation addressed to the Government on the measures to be implemented for the reform of the notary services legal framework, with a view to promoting competition in this activity (Phase A) 1 - Elimination of the numerus clausus principle (as a quantitative barrier to entry); 2 - Elimination of territorial jurisdiction; 3 - Elimination of the notary licensing procedure (without the scrutiny of a public tender); 4 - Elimination of the prohibition of collaboration between notaries and the possibility of the same professional managing more than one notary office; 5 - Amendments to the rules on advertising (notaries are prohibited from advertising their services); 6 - Liberalization of the prices of services provided by private notaries; 7 - Elimination of the Compensation Fund (the notary must assume the economic risk inherent in the exercise of the activity); 8 - Adoption of a principle of cost orientation in the pricing of acts of registrars and registry officers that are part of the material scope of notaries' competences. (Phase B) - Implementation of the proposed measures.
