The company UNIARTE GRÁFICA, SA, sent to the Competition Authority an complaint about the conditions of access to public tenders limited by prior qualification, promoted by the Port and Douro Wines Institute (hereinafter IVDP) for the supply of "knight type" stamps (Procedure no.º 6579/2013), questioning the compatibility with competition law of the minimum requirements imposed in that type of procedure, referring in particular to the requirement of “[curriculum] experience of the candidates in the supply of stamps, in supplies above 40 million, in the years 2009 to 2012, demonstrated through the contracts signed”. The Competition Authority recommended, based on indent b) of paragraph 4 of article 6 of its Statutes, to the IVDP to remove this minimum requirement.
