Summary of the case

The infringement proceeding PRC 2008/09 was opened by the Competition Authority Board on 26.06.2008, concerning a possible breach of Article 4 of Law no. 18/2003, of 11 June.

This investigation analysed practices adopted by the company Royal Canin (Portugal) S.A., which constituted a Vertical Restriction by fixing minimum prices in the General Sales Conditions, by entering into agreements with its retailers that prohibited the practice of discounts on the retail prices it recommended.

On 04.02.2010, the Competition Authority Board adopted a condemnatory decision imposing a fine on Royal Canin in the amount of €218,529.50.

The decision of the Competition Authority was not subject to judicial challenge.
