Summary of the case

On 18.07.2013, the Portuguese Competition Authority (AdC) condemned three companies competing on the producing, processing and marketing flexible polyurethane foam market, as well as their members of the board.

In particular, the investigation showed that between 2000 and 2010 FLEX 2000, FLEXIPOL and EUROSPUMA entered into and executed an agreement and participated in an exchange of sensitive commercial information as to fix their prices on the Portuguese market.

The AdC’s decision concluded the infringement proceeding opened on 01.01.2011 following the submission of two leniency applications and also a transaction proposal. The fines imposed on the companies were in total 993 000 Euros.

The Competition Authority also sentenced five members of the Board of the companies to a global fine of 7 000 Euros.
