Summary of the case

On September 12, 2011, the Portuguese Competition Authority (AdC) opened an infringement proceeding against Copidata, Tompla, Firmo, Antalis and Papelaria Fernandes for cartel practices restricting horizontal competition in the Portuguese market for the production and marketing of envelopes. The AdC's investigation confirmed that between 2007 and 2010, those companies acted together on the national envelope market, dividing customers and agreeing on prices. In particular, the companies manipulated envelope supply proposals, agreeing on the prices to be submitted, in order to artificially determine the company to which the supply would be awarded.
The AdC condemned Copidata, Tompla, Firmo, Antalis and Papelaria Fernandes to pay fines in the total amount of € 1,920,000.00 (one million nine hundred and twenty thousand euros), as follows:
• Copidata: € 1,000,000.00 (one million euros), exempted from payment of the fine under the leniency regime;
• Double: € 320,000.00 (three hundred and twenty thousand euros), exempted from the payment of the fine under the leniency regime;
• Antalis: ordered to pay a fine of € 440,000.00 (four hundred and forty thousand euros), reduced due to the application of the leniency regime and the transaction procedure;
• Firm: ordered to pay a fine of € 160,000.00 (one hundred and sixty thousand euros);
• Stationery Fernandes: it was not possible to set a fine due to the lack of turnover. • The AdC's Decisions were adopted on May 30, 2016, against Antalis under the transaction procedure,  On November 16, 2016, the AdC adopted a decision against Copidata, Tompla, Firmo and Papelaria Fernandes.
