On August 13, 2012, the Portuguese Competition Authority (AdC) opened an infringement proceeding against Otis Elevadores, Lda. (OTIS), following a complaint submitted to the AdC by GIL - Gare Intermodal de Lisboa, S.A. (GIL) against OTIS for alleged high prices, particularly with regard to labor force, replacement parts and equipment provided in the service and maintenance of escalators.
The company OTIS carries out the maintenance, repair, repair, assembly, trade and import of lifts, escalators and any other lifting and transport equipment.
Until September 30, 2011, GIL paid monthly to OTIS an agreed amount for its services, not including replacement parts.
After October 1, 2011, labour force and replacement parts were also included in the bill, as agreed between the parties.
GIL has confirmed to AdC that, at least since October 2011, there were no constraints on obtaining parts from GIL or from any of its competitors on the national territory.
Given the existence of choice regarding the provision of technical assistance and escalator maintenance services, as stated by GIL, at least from October 2011, a possible excessive pricing was not confirmed. Accordingly, the AdC closed the case with a filing decision dated November 7, 2013.
