Summary of the case

The Competition Authority recommended that, within the scope of Law Proposal No. 293/XII, the quantitative limits provided for in Articles 12 to 14 of the Articles of Association attached to that proposal be eliminated. The Competition Authority considered that the establishment of a regime that introduced quantitative limits to the activity to be performed by certified accountants, which could not exceed a certain number of points, which, in turn, would be awarded depending on the turnover of those professionals' clients it would be likely to affect competition, by limiting the ability and incentives of those professionals to compete with each other, not finding sufficient justification in the possible safeguarding of the quality of the services in question. In the absence of a sufficiently weighty justification of public interest, the Competition Authority considered that the legal enshrinement of a regime of conditioning the volume of services provided jeopardized the freedom of competition.
